Terms of Service — A Widow's Way Forward CIC

A Widow's Way Forward CIC (Company number 14555474), registered in England and Wales ("AWWF", "we", "our", "us"), operates the AWWF mobile application (the "App") and the website at http://www.awidowswayforward.org.

2. These Terms
By creating an account, installing the App, or using any AWWF service through the App, you agree to these Terms. If you do not agree, do not use the App. Our Privacy Policy at http://www.awidowswayforward.org/privacy forms part of this agreement and explains how we handle your personal data. Nothing in these Terms affects your statutory rights as a consumer under UK law, including those under the Consumer Rights Act 2015 and the UK General Data Protection Regulation as amended by the Data (Use and Access) Act 2025.
3. Eligibility and Who the App Is For : The App is provided for adults navigating widowhood and supporting family members, donors, and corporate partners. You must be at least 18 to create an account. The App is not directed at, and is not likely to be accessed by, children under 18. We do not knowingly collect personal data from children under 13, as set out in the Privacy Policy.
The App does not provide user-to-user messaging, public posting, or peer content sharing, and is therefore not a "user-to-user service" under the Online Safety Act 2023.
4. What the App Provides /The App offers:
- Guidance content grouped into seven pillars covering financial, emotional, parenting, professional, legal, social, and self-development support
- Booking of one-to-one coaching sessions with AWWF and group sessions.
- Voluntary donations and monthly giving, processed through PayPal
- Optional surveys to inform AWWF's policy and advocacy work
- Ambient music produced by AWWF for use within the App only
- In-app notifications relating to bookings, donations, and surveys
Features may change as the App evolves. We will notify you in-App of material changes that affect how you use the App.
5. Your Account
You are responsible for the activity on your account and for keeping your sign-in credentials confidential. Notify us promptly at support@awidowswayforward.org if you suspect unauthorised access. One account per person. Provide accurate details and keep them up to date.
You can delete your account at any time from the Profile screen. Deletion permanently removes your data, including bookings, donations records, survey responses, and profile information.
6. Acceptable Use
You agree not to:
- Use the App for an unlawful purpose
- Impersonate another person or misrepresent your identity
- Attempt to interfere with the App's security, other users, or our systems
- Reverse engineer, decompile, or attempt to extract source code, except where UK law permits
- Upload content that is abusive, defamatory, unlawful, or infringes another person's rights
- Use the App to harvest data about other users or to send unsolicited communications
We may suspend or close accounts that breach this section. Where the breach is serious or harmful, suspension may be immediate.
7. Coaching Sessions and Bookings
Coaching sessions are delivered by AWWF team members with reasonable care and skill, as required by the Consumer Rights Act 2015. Times are shown in UK Time (GMT/BST). A booking is confirmed only after AWWF reviews and accepts the request. If we cannot offer the chosen slot, we will suggest alternatives.
Where coaching sessions are offered at no charge, this is stated in the App at the time of booking. Where a fee applies in future, the amount and payment method will be displayed clearly before you confirm. Cancellation by you: please cancel at least 24 hours before a scheduled session so the slot can be reallocated.
Cancellation by us: we may reschedule or cancel a session in exceptional circumstances, and will offer an alternative where possible. Coaching supports self-development and is not a substitute for medical, psychological, legal, or financial advice.

8. Donations and Monthly Giving
Donations are voluntary charitable contributions to AWWF, processed through PayPal. You can make a one-time donation or set up a monthly subscription.
Key information before you subscribe to a monthly donation:
- The amount you choose is taken on the same day each month.
- You can cancel the subscription at any time through your PayPal account. Cancellation stops future payments.
- You can also ask us to cancel on your behalf by emailing support@awidowswayforward.org; we will action this within 5 working days.
- No minimum term applies. You can pause or reduce your giving at any time. Cooling-off: if you set up a new monthly donation and change your mind, tell us within 14 days and we will refund the first payment in full. After 14 days, payments made are non-refundable, except where we have made a billing error. One-time donations are generally non-refundable. If you believe a donation was made in error, contact us within 14 days and we will consider the request.
Gift Aid: if you confirm Gift Aid eligibility, we claim Gift Aid in accordance with HMRC rules. You can cancel a Gift Aid declaration at any time by contacting us; cancellation takes effect from that date. Reminders: for monthly donations, we will email you once a year confirming your giving to date. [Aligned with the forthcoming DMCC Act subscription regime, expected to take effect in late 2026.]
9. Intellectual Property
The App, its content, branding, design, and the original ambient music tracks are owned by AWWF or licensed to us. We assert our moral rights under the Copyright, Designs and Patents Act 1988. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes only. You may not copy, redistribute, publish, modify, or create derivative works from our content, including the music tracks, without our written permission.
10. Your Content
You retain ownership of content you submit to the App, including survey responses and profile information. By submitting content, you grant AWWF a non-exclusive, royalty-free licence to store and process it for the sole purpose of delivering the App and producing aggregated, anonymised insights to inform policy and advocacy work. We will not publish anything that identifies you without your consent.
11. Automated Decisions
We do not make decisions about you by solely automated means that produce legal effects or similarly significant effects. This is relevant under Article 22 of the UK GDPR as amended by the Data (Use and Access) Act 2025.
12. Health and Wellbeing Disclaimer
The App and AWWF's coaching are provided for general support and self-development and are not a substitute for professional medical, mental health, legal, financial, or other regulated advice. If you are in crisis in the UK, please contact:

- NHS 111 or 999 for emergencies
The App is provided "as is" and without warranties of any kind, to the fullest extent permitted by law. We do not guarantee uninterrupted access, error-free operation, or that the App will meet your specific needs. This does not affect your statutory rights under the Consumer Rights Act 2015.
13. Third-Party Services
The App uses Supabase (data storage, EU servers), Google Sign-In, Apple Sign-In, and PayPal (donations), as described in the Privacy Policy. Your use of these services is also subject to their own terms and privacy policies. We are not responsible for how those providers operate their services.
14. Accessibility
We aim to make the App accessible to users with a wide range of needs. Where you experience a barrier, please contact us and we will do what we reasonably can to address it.
AWWF commits to WCAG 2.2 AA
15. Limitation of Liability
Nothing in these Terms limits or excludes our liability for:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Breach of statutory rights that cannot be limited or excluded under UK law, including rights under the Consumer Rights Act 2015
- Any other liability that cannot lawfully be limited or excluded. Subject to the above, we are not liable for indirect, incidental, or consequential losses arising from your use of
the App, or for loss of profit, business, or opportunity. Our total liability to you for any other claim is limited to the amount you have paid to AWWF in the 12 months
immediately before the claim, or £100, whichever is higher.
16. Complaints
If something goes wrong, tell us at support@awidowswayforward.org. We will acknowledge your complaint within 30 days and aim to resolve it as quickly as possible. [Acknowledgement timing aligned with the Data (Use and Access) Act 2025 obligations on complaint-handling.] If we cannot resolve a data protection complaint to your satisfaction, you have the right to complain to the Information Commissioner's Office at ico.org.uk or by calling 0303 123 1113. For other consumer complaints, you can also seek advice from Citizens Advice at citizensadvice.org.uk or 0808 223 1133.
17. Termination
You may stop using the App and delete your account at any time from the Profile screen. We may suspend or terminate your access if you breach these Terms, if we are required to do so by law, or if we discontinue the App. Where practical, we will give you reasonable notice.On termination, the licence in Section 9 ends. Sections 9, 10, 12, 13, 15, and 18 survive termination.
18. Changes to These Terms: We may update these Terms from time to time. We will notify you of material changes through the App or by email at least 14 days before they take effect. If a material change disadvantages you, you can delete your account without penalty before the change takes effect. Continued use after the effective date confirms your acceptance of the updated Terms.
19. Governing Law and Jurisdiction. These Terms are governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales. If you reside elsewhere in the UK, you may also bring a claim in the courts of your home jurisdiction. Nothing in these Terms removes the protection of mandatory consumer laws in your country of residence where those apply.
